Terms and Conditions

These terms apply when you use ozmedia.digital and form the default terms for services we supply. If we give you a written proposal, order form or agreement, and it conflicts with these terms, the proposal, order form or agreement applies to the extent of the conflict.

Using this website

You may use the website for lawful purposes only. You must not try to disrupt or gain unauthorised access to the site, scrape it in bulk, send spam through its forms or chat, or use it to mislead anyone. We may limit or block access if we reasonably believe these terms are being breached.

General information only

Articles, guides, calculators, checklists and the AI chat assistant give general information about marketing. They are not legal, financial, tax or other professional advice and do not consider your circumstances. Prices, figures and platform rules change, so check current details before you act on them.

No guarantee of results

Marketing outcomes depend on competition, budget, your product and offer, platform algorithms and other things we do not control. We do not guarantee rankings, traffic, leads, sales or return on ad spend. Case studies and reviews show results for particular clients over particular periods, and yours may differ.

Our AI chat assistant

The assistant is an AI system and can be wrong. Anything it says about pricing, availability or what we will do is general information only. It is not an offer or a contract. A quote or engagement is only binding once we confirm it in writing.

Engaging us for services

• Proposal and scope: the services, fees and any minimum initial term are set out in your proposal or order form. Work outside that scope is quoted separately.
• Fees and GST: our prices are quoted plus GST unless we say otherwise. Payment is due as stated in your proposal or invoice.
• Ad spend and third-party costs: advertising spend is paid to the advertising platform and is separate from our fees. Domains, hosting, software, licences, stock content and similar costs are separate unless the proposal says they are included.
• Minimum term and cancelling: ongoing services usually have a minimum initial term, generally 3 to 6 months, stated in your proposal. After that you may cancel by written notice, and the service ends at the close of the billing month. See our Refund Policy.
• Your responsibilities: you agree to give us timely access, approvals and accurate information, and to make sure your business, offers and advertising comply with the law. This includes consumer law, privacy law, the Spam Act 2003 and Do Not Call Register rules for any marketing messages, and any rules that apply to your industry, such as health advertising rules.
• Third-party platforms: we work within the rules of platforms such as Google and Meta. We are not responsible for account restrictions, policy decisions, outages or changes made by those platforms.

Intellectual property

The website, its text, design, graphics, guides and tools are owned by or licensed to OZ Media Digital. You may view and download guides for your own business use, but you must not copy, resell or republish them without our written permission. Ownership of work we create for you is dealt with in your proposal or agreement. Unless it says otherwise, you own the final approved deliverables once you have paid for them in full, and we keep our own tools, templates and know-how.

Your consumer guarantees and our liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Subject to that, and to the extent the law allows, our liability for a failure to supply services as required is limited to supplying the services again or paying the cost of having them supplied again, and we are not liable for indirect or consequential loss, or for loss of profit, revenue or data.

We link to other websites for your convenience. We do not control them and are not responsible for their content.

Changes

We may update these terms. The version on this page on the day you use the site or agree to a service is the one that applies. The date above shows the latest change.

Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
